DRAFT OF PROPOSED AMENDED BY-LAW, ARTICLE Ill, SECTION 6.

 

Rights of Petition and Criticism

 

The right of any member to publicly criticize with impunity the policies, decisions, and government of the board of trustees is guaranteed.

Any member may propose a change in the rules, regulations, policies, and ordinances of The Stelle Group and this procedure shall be followed to affect change. The proposed change shall be made in writing with the reasons therefore and delivered in person to one of the members of the board of trustees. The board of trustees shall set a time for hearing of the proposal within 14 days after its receipt. The purpose of the hearing is to review the proposed change and weigh all relevant considerations to determine what is for the greatest good for The Stelle Group regarding the matter.

If the proposed change concerns a rule, regulation, policy, or ordinance emanating from a department of The Stelle Group, the petitioner shall first submit the proposed change in writing, with reasons therefore, to the party in the department who is responsible for instituting or administering the rule, regulation, policy, or ordinance in question.

 

If the hearing results in a denial of the proposed change by the board of trustees, a second hearing to be held before a panel of 7 peers may be requested by the petitioner within 7 days from the completion of the hearing before the board of trustees. The panel shall be chosen by lot from among the general membership provided, however, that should a class of membership be created as a result of advanced training, the panel shall be chosen by lot from among this class. The petitioner shall be present at the drawing of the panel by lot. The hearing before the panel shall be held at a mutually agreed upon time within 30 days from completion of the prior hearing unless said time limitation is waived by the petitioner and the board of trustees.

          The responsibility of the panel shall to be review the decision of the board of trustees in light of all relevant considerations and, by majority vote, to sustain the decision or decide to submit the matter to the membership for vote. It shall be within the authority of the panel to modify the proposal before submitting it to the membership. The vote of the membership upon this issue shall be held no later than 30 days from the decision of the panel.

 

If the panel upholds the decision of the board of trustees denying the proposed change, this decision is binding and no hearing before a panel of 7 on a proposal of substantially the same nature can be held within 1 year of the panel’s decision, provided, however, that nothing herein shall be construed to deny the right to a hearing before the board of trustees on any matter within that time period.

 

No policy, rule, or standard set by the departments of religion or education or the admissions committee designed to attain or maintain a quality of excellence within The Stelle Group shall be subject to change under the provisions of this section.
